Bayer insists that glyphosate is not carcinogenic, a position supported by the US Environmental Protection Agency (EPA). The agency’s assessment is that “there is no risk to public health when glyphosate is used according to the current label.” Instead, the International Agency for Research on Cancer (IARC), a subsidiary of the World Health Organization, has determined that glyphosate is “probably carcinogenic” to humans — an assessment that California uses to determine which substances qualify for Proposition 65. are covered by and thus, require a cancer warning label.

In Thursday’s announcement, Bayer also laid out plans for the next Roundup case. In August, the company will petition the Supreme Court to review the Hardman case, in which a jury found the company failed to warn residential users about the cancer risks of glyphosate. The company argues that it cannot market Roundup with a cancer warning label, because federal law preempts state warning requirements.

It is not yet clear whether the Supreme Court will also examine the case. Because of this, the company told shareholders that it would spend $4.5 billion to settle future claims.
“If the Supreme Court accepts the case, we believe Mr. Hardman will prevail.” Attorney Amy Wagstaff, who represents Hardman, told The Counter in an email. Regarding Bayer’s decision to phase out Roundup, Wagstaff said that “removing glyphosate from the residential market [is] a good start.”
